THE ESSENCE AND CONTENT OF MODERN PRINCIPLES OF PROCEDURAL LAW

Abstract:
the article is devoted to the study of the modern system of principles of procedural law, through the prism of doctrinal approaches. The paper analyzes not only theoretical concepts and terms, but also analyzes the materials of judicial practice, examines legal positions to the sectoral principles of the constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation. Justifies point of view about the necessity of clarifying the procedural law in terms of implementation of selected principles of law in the code of civil procedure of the Russian Federation, the APC and the APC.

Abstract:
Expertise of normative legal acts and their drafts plays an important role in the mechanism of ensuring of effective implementation of law-making decisions and creating high-quality, noncontradictory legislation. This is due to the high requirements for the legal regulation of the institute of expertise in law-making. The subject of this article is the federal legal regulation of the expertise of normative legal acts and their drafts. The research is aimed at identifying its inherent problems and formulating solutions to them. The paper uses systematic, formal-logical, formal-legal methods to determine trends in the modern development of the institute of expertise in law-making, describes the current state of its legal regulation, identifies and analyzes its advantages and disadvantages, evaluates particular law-making initiatives to reduce the number of professional examinations of normative legal acts and their projects, compares professional and non-professional (public discussion of draft normative legal acts) expertise in law-making. Conclusions are made about the expediency of passing normative legal acts and their projects through an expanded number of examinations, about the importance of a comprehensive assessment of a law-making decision, including with the help of the new digital technologies.

Abstract:
In the article the author makes an attempt to analyze the effectiveness of legal norms in regulating the protection of victims of armed conflicts. Various views of scientists on the problem of the effectiveness of norms in regulating the issues under consideration are considered. The reasons of ineffectiveness of regulation of protection of victims of armed conflicts are investigated. The author explores ways to overcome problems in this area, based on the opinion of scientists, and the modern experience of regulation in this area. The article examines the issues of the impact of armed conflicts on international treaties, violations of human rights and the consequences of these violations in society.

Abstract:
Activities carried out in merchant shipping that are international in nature have a strict division of functions between all participants, since they require constant maintenance of its dynamics and compliance with the deadlines for the execution of numerous transport and related contracts. This need for division of labor has led to the emergence of a specific intermediary — a Maritime agent who takes over the execution of numerous formalities, performing various types of actions, thereby greatly facilitating the service of a foreign ship in the port. The purpose of the article is to assess the effectiveness of legal regulation of the contract of Maritime Agency in modern commercial navigation. The features of the legal nature of Maritime Agency agreements are revealed. The author analyzes the existing approaches to the formation of sources of legal regulation in this area, both through the unification and creation of national norms. The conclusion is made about the advantage of applying the established customary rules of the law of the sea, which remain for a long time one of the most effective regulators of Agency relations.

Abstract:
The article discusses the prospects for the development of international labor law in the context of the study of international law crises. Among the crisis phenomena, the author notes: the lag of previously developed norms from the actual modern international and domestic life, non-compliance or improper implementation of existing international legal norms, and the lack of development of the conceptual apparatus. According to the author, a large array of international labor law norms needs to be revised due to rapidly changing conditions of socio-economic life. The article also touches on the topical issue of regulating remote labor in the context of a pandemic.

Abstract:
This article outlines the existing approaches to determining the remuneration of workers in the budgetary and non-budgetary spheres of the economy. The main emphasis is placed on the analysis of reforms aimed at improving the remuneration of employees of state and municipal institutions as the least adapted to modern conditions of technological progress for economic entities. Despite numerous attempts, the problem of raising the wages of such workers has not yet been resolved. Meanwhile, identifying errors, it is possible to outline the ways to eliminate them and determine the directions for the further development of legal regulation of relations on remuneration of workers.

Organic farming while being environmentally beneficial as compared to conventional farming remains a source of such problems as water pollution by non-point effluents containing organic fertilizers, uncontrolled growth of methane emissions from vaster plough lands, threat to adjoining forests. Negative impacts on the environment from non-point sources are not regulated by the environmental legislation that leaves the organic farming beyond any environmental controls. Further development of organic farming may face lack of sufficient areas of high-quality plough lands that requires to strengthen conservation of available lands in the legislation.

The article addresses the issues of legal provision of completeness and reliability of information about genetically modified organisms intended for release into the environment. The author investigated contradictions in the legal regulation of genetic engineering activities, gaps in the legislation on the production of organic products, investigated court practice. The author concludes that legislation needs to be improved to ensure that information on the content or absence of genetically modified organisms in agriculture is reliable. The law requires the state registration of genetically modified organisms, but administrative responsibility is established for the commission of acts in the form of the use of GMOs that have not been registered. The article substantiates proposals aimed at eliminating the identified contradictions.
